Rubbish Collection Kensington Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Collection Kensington provides waste and rubbish collection services to residential and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following words have the meanings given below:

Customer means the person, company or organisation ordering or receiving the rubbish collection service.

Service means any waste removal, rubbish collection, recycling collection, bulky waste removal, or similar services provided by Rubbish Collection Kensington.

Agreement means the contract between the Customer and Rubbish Collection Kensington for the provision of Services, comprising these Terms and Conditions and any agreed quotation or booking confirmation.

Waste means any rubbish, refuse, junk or other material to be collected, removed, recycled, or disposed of as part of the Service, subject to applicable waste regulations.

2. Scope of Services

Rubbish Collection Kensington provides waste and rubbish collection services to residential and business premises within its operating area. The specific scope of each Service, including the type and volume of waste to be collected, collection address, date, time window, and price, will be as set out in the quotation or booking confirmation.

We reserve the right to refuse to collect any item or material which is not included in the agreed Service, which is prohibited by law, or which presents a health, safety or environmental risk to our staff or the public.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through our online booking system, where available. All bookings are subject to availability and acceptance by Rubbish Collection Kensington.

3.2 When placing a booking, the Customer must provide accurate and complete information, including the collection address, access details, contact information, description and approximate quantity of the waste, preferred collection date and time, and any relevant access or parking restrictions.

3.3 Based on the information provided, we will either provide a quotation or an estimated price. In some cases, we may need to inspect the waste on site before confirming the price. Any quotation is given on the assumption that the information supplied by the Customer is accurate and that normal access is available.

3.4 A booking is deemed accepted and the Agreement formed when the Customer receives confirmation from Rubbish Collection Kensington, whether in writing, by email, by text message, or verbally, and the Customer confirms acceptance of the quoted or estimated price and these Terms and Conditions.

4. Service Delivery and Access

4.1 The Customer must ensure that our collection team has safe, suitable and timely access to the premises and the waste to be collected at the agreed time. This includes arranging any necessary parking permissions, access codes, gate entry or passes in advance.

4.2 If access is delayed or restricted, or if the waste is not available as described at the time of booking, Rubbish Collection Kensington may charge a waiting fee, an additional visit fee, or a revised price for the Service to reflect extra time, labour or disposal costs. In some cases, we may need to cancel or rebook the Service and apply a cancellation charge.

4.3 The Customer or an authorised representative should be present at the premises during collection to identify the waste to be removed and to sign any job completion form if requested. If no representative is present, we will assume that the waste placed in the agreed location is correct, and our records of the waste collected will be conclusive.

5. Waste Description and Exclusions

5.1 The Customer is responsible for accurately describing the type and quantity of waste for collection. If, upon arrival, the actual waste differs substantially in type or volume from that described at the time of booking, we may revise the price or refuse part or all of the Service.

5.2 Certain types of waste are excluded from standard Services and may require special arrangements or licences. These may include, but are not limited to, hazardous waste, chemicals, solvents, asbestos, medical or clinical waste, gas bottles, pressurised containers, oil, paint, tyres, and electrical or electronic items that require special handling under waste regulations.

5.3 Where we agree to collect items requiring specific compliance under waste regulations, additional documentation, processes or charges may apply. Any such arrangements will be confirmed to the Customer in advance where reasonably practicable.

6. Pricing and Quotations

6.1 Prices for our rubbish collection services are based on factors that may include the type and volume of waste, the labour required, access conditions, loading time, disposal or recycling costs, and travel time.

6.2 Any quotation provided prior to inspection is an estimate only, based on the information supplied by the Customer. The final price may change if the actual waste, access or labour requirements differ from those described.

6.3 We will notify the Customer of any change to the price before commencing the Service wherever possible. If the Customer does not accept the revised price, we reserve the right to cancel the Service and apply a call-out or cancellation charge to cover costs incurred.

7. Payment Terms

7.1 Unless otherwise agreed in writing, payment is due in full on completion of the Service. We may require a deposit or full pre-payment to confirm a booking, particularly for larger collections or commercial jobs.

7.2 Payment may be made by cash, credit or debit card, bank transfer, or other methods we make available from time to time. We do not accept payment by cheque unless expressly agreed in advance.

7.3 For approved account customers, invoices are payable within the agreed credit terms from the invoice date. If no specific credit terms are agreed, invoices are payable within 14 days of the invoice date.

7.4 If the Customer fails to make any payment by the due date, Rubbish Collection Kensington may charge interest on the overdue amount at the statutory rate, and may suspend further Services until full payment is received. The Customer will be responsible for any reasonable costs incurred by us in recovering overdue amounts, including legal costs and collection fees.

8. Cancellations and Amendments

8.1 The Customer may cancel or amend a booking by contacting us during normal business hours. Cancellations or changes must be confirmed by us to be effective.

8.2 If the Customer cancels the Service more than 24 hours before the scheduled collection time, any pre-payment will normally be refunded, less any reasonable administrative costs. For cancellations within 24 hours of the booking time, we reserve the right to charge a cancellation fee to cover the costs of lost time and allocation of resources.

8.3 If the Customer is not present at the agreed time, fails to provide access, or the waste is not available for collection as booked, this may be treated as a late cancellation, and a call-out or cancellation fee may be charged.

8.4 Rubbish Collection Kensington reserves the right to cancel or reschedule a booking due to circumstances beyond our reasonable control, including severe weather, vehicle breakdown, staff illness, traffic disruption, safety concerns, or legal or regulatory issues. In such cases, we will use reasonable endeavours to notify the Customer as soon as practicable and to rearrange the Service for a mutually convenient time. We will not be liable for any loss or damage arising from such cancellations or delays, except as required by law.

9. Customer Obligations

9.1 The Customer must ensure that all waste to be collected is properly bagged, contained or otherwise prepared, in accordance with any instructions provided by us. Heavy or bulky items should be made safe for handling, and any sharp or dangerous materials must be clearly identified or securely wrapped.

9.2 The Customer must not present for collection any waste that is unlawful to handle, transport or dispose of, or which would cause Rubbish Collection Kensington to be in breach of relevant waste regulations or other legal obligations.

9.3 The Customer warrants that they have authority to arrange for the removal of all waste presented for collection and that such waste is free from ownership or security interests that would prevent its lawful removal and disposal.

10. Compliance with Waste Regulations

10.1 Rubbish Collection Kensington operates in accordance with applicable UK waste management and environmental regulations. We will use authorised facilities for the transfer, recycling and disposal of waste, and will take reasonable steps to maximise recycling and minimise landfill where practicable.

10.2 Where required by law, we will maintain records and documentation such as waste transfer notes, consignment notes, and records of the destination of waste materials. The Customer may request copies of relevant documentation for their records, subject to a reasonable administrative charge where applicable.

10.3 The Customer agrees to co-operate with us in complying with waste regulations, including the accurate description and classification of waste, segregation of different waste types where required, and provision of any information reasonably requested in relation to the waste.

11. Liability and Insurance

11.1 Rubbish Collection Kensington will exercise reasonable care and skill in providing the Services. Our liability to the Customer is limited as set out in this clause, to the fullest extent permitted by law.

11.2 We hold appropriate insurance cover for our operations, including public liability insurance. Details of our insurance can be provided on request.

11.3 We will not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the provision or non-provision of the Services.

11.4 Our total liability for direct loss or damage arising from a single event or series of connected events shall not exceed the total amount paid or payable by the Customer for the specific Service in relation to which the claim arises.

11.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

12. Damage to Property

12.1 While we take reasonable care when carrying out rubbish collection, the Customer is responsible for protecting driveways, floors, fixtures, fittings and any vulnerable areas that may be at risk during the loading and removal process.

12.2 We will not be liable for cosmetic damage to driveways, floors or surfaces caused by the movement of heavy items or vehicles, unless such damage results from our negligence. If large vehicles are required to access the Customer's premises, the Customer accepts the risk of minor surface wear consistent with normal use.

13. Force Majeure

13.1 Rubbish Collection Kensington shall not be liable for any failure or delay in performing our obligations under the Agreement where such failure or delay results from events, circumstances or causes beyond our reasonable control. These may include, without limitation, extreme weather, natural disasters, acts of government or regulatory authorities, traffic incidents, strikes, lockouts or other industrial disputes, breakdown of plant or machinery, or disruption to utilities or transport networks.

14. Complaints

14.1 If the Customer has any concerns or complaints about the Service, they should contact us as soon as possible, providing full details of the issue and any supporting information.

14.2 We will investigate complaints in a timely and fair manner, seeking to resolve issues promptly, and may request further information or evidence from the Customer if needed.

15. Variations to Terms

15.1 Rubbish Collection Kensington may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to the Agreement for that particular Service.

15.2 Any changes to the scope of Services, prices or specific terms agreed with the Customer must be confirmed by us, and will not take effect unless and until accepted by both parties.

16. Data Protection and Privacy

16.1 We will collect and use personal information provided by the Customer for the purposes of managing bookings, providing Services, taking payment, and for related administrative and business purposes.

16.2 We will handle personal data in accordance with applicable data protection laws and our privacy practices, and will take reasonable steps to protect personal information from unauthorised access, loss or misuse.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any Agreement for the provision of rubbish collection services by Rubbish Collection Kensington are governed by and shall be interpreted in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Agreement, or the provision of the Services.

18. General Provisions

18.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall, to the extent required, be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected.

18.2 No failure or delay by Rubbish Collection Kensington in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

18.3 The Customer may not assign or transfer any of their rights or obligations under the Agreement without our prior written consent. We may transfer our rights and obligations under the Agreement to another suitable provider, provided that this does not adversely affect the rights of the Customer.
